A title deed is a certificate of registration of immovable property. Check whether the property is registered in the seller’s name and whether ownership has actually been transferred to you. A missing paper certificate and an uncompleted ownership transfer are different situations.
DLS’s buyer brochure distinguishes immediate title transfer, purchase through a sale contract, and assignment from an existing purchaser who is not the registered owner.
What should I check on the title and other records?
Request a recent certificate of registration from the seller. Use a separate search certificate to investigate encumbrances and prohibitions, including mortgages and deposited contracts. Check the planning zone, applicable development rules and building approvals separately; do not assume the paper title is a complete planning or mortgage report.
For a unit resulting from a division, DLS advises checking the division arrangements, any deposited distribution agreement, common areas, exclusive-use rights and the share in common areas. Ask your lawyer to distinguish ownership of a separate unit from an undivided share in the underlying property. Do not infer the rights to a particular house from an advertised fraction such as “1/2”.
Foreign buyers: have the particular acquisition checked under Chapter 109. EU and EEA citizens are excluded from its foreigner definition, and other exclusions exist. For acquisitions within the permission regime, the Ministry directs applicants to the District Administration where the property is located, using COMM 145. Its published categories and limits are explained in the official purchasing guide. An advertisement saying “OLO” is not a substitute for that assessment.
How do I obtain a copy of an existing title?
The DLS title-copy application lists €10 for each title deed.
- Online submission requires a registered and identified CY Login profile.
- Alternatively, email a District Lands Office with the signed application, copies of both sides of your identity card or ARC, or your passport, plus a postal address and contact telephone numbers.
- Applications by parents of a minor registered owner or the administrator of a deceased owner’s property must use the email route and include the specified additional evidence.
Once the application status becomes “Completed” or “Pending (Official) Certificate Dispatch”, DLS makes an unofficial PDF available within the application for 120 days. This download period is not a promised processing time.
How does purchase lead to registered ownership?
Where an existing title can be transferred
DLS advises proceeding with immediate transfer after the necessary research, where there are no outstanding financial or other issues. Ask your lawyer and DLS to confirm the transfer documents and required tax settlements for the particular transaction. DLS also advises not paying the full purchase price before transfer of the certificate into your name.
Budget transfer fees using the transaction’s actual VAT treatment and applicable exceptions. See the property-tax guide; a discounted transfer fee is not the same as exemption from the fee.
Where transfer must wait
DLS recommends concluding and depositing a sale contract where financial or other outstanding issues postpone transfer. Under Law 81(I)/2011, ordinary deposit is subject to statutory conditions, including a six-month deadline from signing. Ask your lawyer to check those conditions and any applicable exceptions before signing.
For sale contracts within section 4(1A), the seller must include a search certificate as an integral part of the contract, dated within five working days of signing. This provision was added by the amendment effective 12 December 2023.
Accepted deposit provides statutory protection, but does not itself transfer registered ownership or erase prior mortgages. Check the existing encumbrances and the applicable mortgage-release arrangements.
For a new unit under construction or a plot under construction, the DLS brochure says it cannot yet be registered with its own certificate. Registration requires a completion-of-works certificate from the supervising engineer and a certificate from the competent Building Authority. If construction is complete but no separate title has been issued, investigate why and make the contractual responsibilities explicit.
Can a shared property be divided into separate titles?
Check the appropriate DLS division or partition procedure for the actual property and its permits. Do not assume that two adjoining houses automatically have separate titles, or that every procedure requires unanimous consent.
For example, the DLS section 29(9) procedure concerns compulsory partition of properties held in undivided shares in development areas, where the relevant planning and competent-authority permits are required. Registered co-owners holding at least 25% can apply. This application route does not establish that a specific property can be divided or that permission will be granted.
Ask about the resulting units, common areas, access and rights of use before agreeing to buy. Obtain a property-specific timetable rather than relying on a generic number of months.
How do I obtain ownership and encumbrance information?
The DLS search-certificate application covers a property of a specific owner, with or without encumbrances and prohibitions. It lists €10 for a simple certificate and €15 with encumbrances and prohibitions.
Information access is subject to the interested-person rules under section 51A of Chapter 224. The current application requires evidence of that interest if the applicant is not an owner. Ask the seller to provide the appropriate certificate or arrange lawful access through your representative; this is not an unrestricted public owner lookup.
What is an assignment agreement?
An assignment transfers an existing buyer’s rights and obligations under the sale contract to an assignee. The DLS assignment application says the seller’s written consent is not necessary for that assignment. This is distinct from buying directly from the registered owner or transferring registered ownership.
For DLS to accept deposit, the original sale contract must already be deposited. The assignment must identify the parties and property, its date and any consideration, and clearly reference the sale contract. The ordinary deposit deadline is six months from signing, unless a court order permits late deposit. The checklist includes original signatures and TF 411, the certificate settling capital gains tax and the Central Agency for Equal Distribution of Burdens levy. Check the signature-certification requirements and the complete current checklist with your lawyer.
Before taking an assignment, DLS advises checking the original contract’s deposit, outstanding amounts owed to the seller and encumbrances before or after that deposit.
Assignment fees and stamp duty are separate
The DLS application lists:
| Assignment category | DLS deposit fee |
|---|---|
| Between relatives up to the third degree, or spouses | €20 |
| Other assignments | 0.5% of the higher of the sale-contract price and assignment-contract amount; minimum €50, maximum €3,000 |
Stamp duty was repealed from 1 January 2026. The Tax Department says documents prepared and signed by at least one party by 31 December 2025 remain subject to the earlier rules. This repeal does not remove the DLS fees above. Ask DLS about the treatment of a proposed simultaneous transaction rather than assuming every assignment is free.
What practical checks should I make?
- Confirm the registered owner and the precise property or share being sold.
- Review a recent search certificate, the permits and any mortgage-release arrangements before committing funds.
- Check whether the transaction is an immediate transfer, a sale contract or an assignment, and meet the applicable deposit conditions.
- For a new or divided unit, clarify who is responsible for completion certificates, separate registration and transfer.
- Request a written breakdown of taxes, DLS charges and professional fees for the actual transaction.
