Short answer: Permission to acquire property, registered ownership and immigration residence are separate matters. Check which foreign-buyer permission rules apply, the property’s legal status, the contract and the actual VAT treatment before paying.
This guide focuses on the foreign-buyer permission regime. For the wider process, costs and a dated market-index snapshot, see our property buying guide.

Who can buy property in Cyprus?
Cap. 109 excludes EU/EEA citizens from its foreign-buyer definition. Foreign companies and foreign-controlled companies can fall within the regime; incorporation in Cyprus alone does not establish an exemption. Check the statutory definition and your circumstances.
Current Ministry guidance permits:
- A building plot or undivided land up to 4,000 m² for an owner-occupied dwelling; or
- Up to two qualifying units: two dwellings, or a dwelling plus a shop up to 100 m², or a dwelling plus an office up to 250 m². The restriction applies jointly to couples.
Permission application
Use COMM 145 with the required documents through the District Administration where the property is located. The Ministry states no application fee and a two-to-three-week processing estimate; approval and timing are not guaranteed.
Under Cap. 109, section 3, an acquisition contract does not itself give a buyer within the regime the right to acquire ownership without the required permission. Obtain advice before signing or paying. Permission to buy does not itself confer immigration residence.
What is the step-by-step buying process?
1. Signing the Sale Contract
Ask an independent lawyer to review the contract, title and permissions. For deposit under Law 81(I)/2011, section 3, the contract must be written, sufficiently identify the parties and property, state the consideration and be signed by all parties. Under section 4(1A), for contracts concluded after the 2023 amendment took effect, the seller must include a Search Certificate dated within five working days of signing as an integral part of the contract.
Stamp duty was repealed from 1 January 2026 under Law 239(I)/2025. Documents signed by any party before that date retain the earlier stamp-duty rules.
2. Deposit at the Land Registry
The ordinary statutory deposit deadline is six months from signing, subject to section 3 conditions and exceptions. An accepted deposit creates an encumbrance with priority from the deposit date. Sections 3A and 5 provide additional mortgage-related protections and procedures; deposit does not automatically erase prior mortgages or guarantee completion. The current DLS procedure lists a EUR 50 contract-deposit fee; confirm the submission requirements for your file.
3. Obtaining the Title Deed
A certificate of registration confirms registration in the DLS Land Register. Check the applicable situation:
- Existing separate title deed and no encumbrances: check the DLS sale/exchange requirements, tax clearances, identity documents and applicable foreign-buyer permission. DLS advises against paying the full purchase price before title transfer
- Signed sale contract but transfer postponed: arrange deposit within the ordinary six-month deadline, subject to the statutory conditions and exceptions described above
- New build or unit still under division: a separate title deed cannot be issued until the required completion and building-authority certificates exist; require a contractual deadline for the seller to obtain permits, certificates, and the certificate of registration
How does the reduced 5% VAT on first homes work?
The ordinary reduced-rate scheme concerns an individual aged 18 or over, using the dwelling as their main and permanent residence in Cyprus, with the other statutory eligibility conditions. It is not simply a first-purchase discount.
- First 130 m² with a EUR 350,000 reduced-rate value cap.
- Total area must not exceed 190 m² and total value must not exceed EUR 475,000 for the ordinary scheme.
- Area/value allocation determines the part taxed at 5%; the standard rate is 19%. Disability and large-family provisions have separate conditions.
- Changing qualifying use within ten years can trigger repayment of the actual original saving, proportionate to the remaining period. Notify and pay within 30 days; check the statutory death and eligible-child transfer exceptions.
Follow the current Tax Department application instructions and provide the required supporting documents. Confirm the approved tax treatment before budgeting or invoicing; company affiliations alone do not establish eligibility. See our property-tax guide for the transition and full conditions.
How does permanent residence through property purchase work?
A qualifying investment may support an application under Regulation 6(2). This is separate from ordinary Category F, and a purchase alone does not guarantee approval.
For the residential route, current policy normally requires a developer’s first sale of a house/apartment, with at least EUR 300,000 excluding VAT paid and documented funds from abroad. The policy includes a historical pre-7-May-2013 residential resale exception and specific applicant/spouse/company payment-account conditions.
Other requirements include:
- Secure annual foreign income of EUR 50,000, plus EUR 15,000 for a spouse and EUR 10,000 for each minor. A tax return or an independent certified accountant’s official certification may evidence it.
- Applicant/spouse clean criminal records from origin and residence countries where different, public-order/security criteria, suitable accommodation and health-insurance conditions.
- Spouse and children under 18 may be included; certain adult dependent children have separate conditional application rules.
- No general employment right: the applicant/spouse declare they do not intend employment, subject to the policy’s director exceptions. Obtain route-specific advice before changing an existing work/residence arrangement.
Maintain the qualifying investment and comply with continuing conditions. The 17 May 2023 clarification removed annual income-proof submission, requires criminal-record certificates every three years, and retains annual investment evidence and insurance evidence where not GESY beneficiaries. Check the current investor-route supporting-document checklist, including any examination requirements, rather than assuming the separate Categories A–F announcement determines this route.
Read the official investor policy and clarifications before selecting property for a residence application.
What practical tips should I know?
When choosing a property:
- Check for the seller’s title deed
- Clarify the history of permits (planning, building)
- Ensure there are no encumbrances on the property
When completing the transaction:
- Hire an independent lawyer (not from the developer)
- Deposit the contract at the Land Registry as early as possible
- Keep all payment documents to confirm the origin of funds
When paying from abroad (GBP, USD, other currencies):
Compare provider quotations for the actual currency, amount and route: total fees, exchange rate, euros received and any intermediary-bank charges. Do not assume a universal bank or specialist-provider percentage. Keep records showing the source and route of the payment.
British buyers: UK nationality alone does not give EU/EEA citizenship. Check the applicable Cap. 109 permission requirement and obtain advice from a lawyer qualified for the Cyprus transaction; property permission is separate from immigration residence.
